Service Description
Settled is a dispute-resolution platform that supports case intake, evidence handling, mediation workflow, and proposal coordination. The platform includes an AI-assisted intake assistant that helps users describe and structure their case.
Acceptance of Terms
By accessing or using the Settled platform, you acknowledge that you have read and agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the platform.
Platform Access
The platform is made available to registered users in connection with dispute resolution activities. Access is subject to account eligibility, applicable law, and our right to suspend or restrict access for violations of these terms or for operational reasons.
User Responsibilities
Users are responsible for their accounts and for all activity that occurs under their credentials.
Account Security
Maintain the confidentiality of your login credentials. You are responsible for all actions taken under your account.
Accurate Information
Provide and maintain accurate account and case-related information.
Authorized Use
Use the platform only for its intended purposes in connection with legitimate dispute resolution workflows.
Legal Compliance
You are responsible for using the platform in accordance with applicable laws and regulations in your jurisdiction.
Evidence Responsibility
When you upload evidence to a case, you take on specific responsibilities for that material.
Right to Upload
You represent that you are authorized to upload the evidence you submit and that doing so does not violate the rights of any third party.
Accuracy and Integrity
You are responsible for ensuring that uploaded files are accurate, authentic, and free from malicious content.
AI Does Not Review Evidence
The AI assistant does not review the contents of your uploaded files. AI sees limited metadata about attachments (such as filename, content type, and a derived classification), not file contents. This is described in our Privacy Policy and Security Protocol.
Content and Submissions
Users may submit case documents, evidence, and related materials through the platform.
Ownership
You retain ownership of content you submit. By submitting content, you grant us a limited, non-exclusive license to host, store, transmit, display, and process that content as needed to operate the platform on your behalf.
Content Standards
You are responsible for ensuring submitted content is accurate, authorized, and does not violate applicable laws, regulations, or third-party rights.
Prohibited Content
You may not submit content that is fraudulent, unlawful, defamatory, abusive, or otherwise in violation of applicable law or these terms.
AI Assistance Disclaimer
The platform uses AI to assist users with intake and case structuring. The role of AI is intentionally limited.
Assistive Only
AI is assistive only. AI does not make decisions, provide legal advice, or determine dispute outcomes. Any AI output is a suggestion that workflow logic or a human must adopt.
Not Legal Advice
Nothing produced by the AI assistant is legal advice. If you need legal advice, consult a qualified professional in your jurisdiction.
User Judgment Required
You are responsible for reviewing AI-generated suggestions before acting on them. Use of AI suggestions is at your own discretion.
Acceptable Use
Use of the platform is subject to the following restrictions in addition to those described elsewhere in these terms.
No Abuse
Do not use the platform to harass, threaten, or defame others.
No Misuse of AI
Do not attempt to circumvent the AI assistant's safety controls, extract system instructions, or use the platform to generate harmful content.
No Unauthorized Access
Do not attempt to access accounts, cases, or data that you are not authorized to view.
No Reverse Engineering
Do not reverse engineer, decompile, or attempt to extract the source code of the platform.
Intellectual Property
The Settled platform, its software, design, and documentation are owned by MediateFlow Technologies and protected under applicable intellectual property law. These terms do not transfer any ownership rights to you. You receive only the limited right to use the platform in accordance with these terms.
Disclaimer of Warranties
The platform is provided on an 'as is' and 'as available' basis. We do not warrant that the platform will operate without interruption, error, or data loss. To the extent permitted by applicable law, we disclaim all express, implied, or statutory warranties, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
Limitation of Liability
To the extent permitted by applicable law, MediateFlow Technologies and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the platform. Our total aggregate liability to you will not exceed the greater of amounts paid for the service in the twelve months preceding the claim or the minimum amount required by applicable law.
Changes to the Service or These Terms
We may update the platform or these Terms of Service to reflect changes in the service, applicable law, or operational practices. Material changes will be communicated through appropriate product or account channels. Continued use of the platform after such notice constitutes acceptance of the updated terms.
Governing Law
These terms are governed by applicable law as specified in any separately executed service agreement. Where no such agreement exists, disputes will be resolved through appropriate legal channels in the applicable jurisdiction.
